ACTIVATE Terms & Conditions

No program works unless you do. If you’re expecting ACTIVATE, or anything else to magically solve your problems, grow your blog, or make you money the moment you register, please do NOT sign up. Our products are designed to show you the steps you’ll need to take to grow a successful, profitable online business, but YOU will still need to take those steps.

Our products are not some “get rich quick” program, nor do we offer some top-secret formula or magic bullet that promises untold riches with no effort on your part. Plus, we actually care that you complete and implement the material provided in the course. That’s why upon registering you must agree to complete the assignments and to actually do the work, in the order it is prescribed.

Please also be aware that there is no guaranteed timeline for growing a successful business. The speed at which your business grows will depend on a variety of factors, many of which we cannot predict. That said, we do know that our most successful students are the ones who keep moving forward and refuse to quit or to compare their progress to others.

Personal Use Policy

When you enroll in our ACTIVATE coaching program, you understand that you are purchasing a license to use the site for your own use.

Sharing access to any of our material  is NOT allowed and is a breach of our terms and conditions. If you have a partner or key employee that you would like to also access our program, you must contact us at support@ruthsoukup.com to apply for an add-on membership. Please note that you will be required to provide proof of partnership or employment.

Your access may not be shared or transferred. If any employee of RSO, Inc. finds that students are sharing access, subscribing to the program for multiple users, or has made any offers or agreements to do such, your access will be immediately revoked, you will forfeit your payment, and you will be liable for damages to Ruth Soukup and Ruth Soukup Omnimedia Inc. Please respect the proprietary nature of this information.

ACTIVATE Cancellation and Refund Policy

You are free to cancel your membership at any time, and you will retain access to all program materials until your current payment period is complete. 

While there is no financial penalty for cancelling, we do not provide refunds nor do we prorate any uncompleted time in the program. You must cancel at least 3 business days before your auto payment is charged, or you will be charged for an additional billing period of the program. Once you cancel your membership, you will not be able to rejoin the program for one full calendar year.

ACTIVATE Confidentiality & Code of Conduct

We require all members of the ACTIVATE coaching program to read the terms of this Confidentiality Agreement and Code of Conduct, and agree to abide by them before acceptance into the ACTIVATE program.

WHY?

The purpose of these agreements are to protect the privacy of the material presented in the program, as well as maintain the integrity of the group and its members.

Knowing that everyone has agreed to the terms will make it easier for us to elaborate on content freely in the Facebook Group, Live Q&A sessions, webinars, material shared/offered, trainings, and any other means of communication with ACTIVATE members.

IF YOU DO NOT AGREE…

If you do not agree to the terms in this Confidentiality Agreement you will be voluntarily choosing to not participate in the ACTIVATE coaching program.

IF YOU DO AGREE…

All information you hear and or receive within the ACTIVATE Coaching Program will be considered Confidential Information, unless the subject of that information clearly states otherwise. This information may be personal or business.

You agree that you will not disclose any of this Confidential Information to anyone who is NOT a member of the ACTIVATE program, and that violating any confidentiality will be grounds for immediate removal from the group, and forfeiture of your membership fees.

ACTIVATE GROUP CONFIDENTIALITY AGREEMENT

It is understood and agreed to that the identified discloser of confidential information may provide certain information that is and must be kept confidential.

To ensure the protection of such information, and to preserve any confidentiality necessary under copyright, patent and/or trade secret laws, it is agreed that:

The Confidential Information to be disclosed can be described as including, but is not limited to: Invention description(s), technical and business information relating to proprietary ideas and inventions, ideas, patentable ideas, trade secrets, drawings and/or illustrations, patent searches, existing and/or contemplated products and services, research and development, production, costs, profit and margin information, finances and financial projections, customers, clients, marketing, and current or future business plans and models, regardless of whether such information is designated as “Confidential Information” at the time of its disclosure.

The Recipient agrees not to disclose the confidential information obtained from the discloser to anyone unless required to do so by law.

This Agreement states the entire agreement between the parties concerning the disclosure of Confidential Information. 

If any of the provisions of this Agreement are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Agreement as a whole.

WHEREFORE, the parties acknowledge that they have read and understand this Agreement and voluntarily accept the duties and obligations set forth herein.

CODE OF CONDUCT

The ACTIVATE Coaching Program is your space to connect, create, share, and inspire while you build a successful, profitable, and predictable online business. It’s up to us to keep the ACTIVATE community a safe, accepting and encouraging group for everyone, so please read the Code of Conduct below:

  1. BE KIND. 

We have a zero tolerance policy for negativity, bullying, drama, gossip, or toxic energy. Encourage and support your fellow ACTIVATE members. While healthy discussion is encouraged, your words should be chosen carefully and spoken with love and respect.

Please work hard to make sure that no one in our community feels unwelcome or judged; treat everyone with kindness, love, patience and respect. If you disagree or have an opposing viewpoint to share, do it with respect, honor and from a place of compassion.

Spirited debate about ideas or concepts is awesome, personal attacks are not. If you can’t be kind, be quiet. Violation of this rule is grounds for immediate and permanent removal from the group.

  1. DON’T TRASH TALK. 

This is a no trash talking zone about Ruth, Team RSO, Elite Blog Academy™,  the ACTIVATE program, or anyone else. We don’t put anyone down, be it other products, programs or people. This applies to issues with other ACTIVATE members as well.

Do not create drama by stating “A certain person did X and I’m so upset” or “Someone in this group did Y, that wasn’t cool.”

If you have an issue or grievance – either with the program, or each other, bring it directly to the party you have issue with, and/or write directly to our support team at support@ruthsoukup.com

  1. BE GENEROUS. 

Give more than you ask. Share what you’re working on, but keep a larger emphasis on sharing support, wisdom, and encouragement. Think 3:1. Give 3 times more support, insight, and encouragement than you ask for.

  1. DON’T SPAM, MASS MAIL, OR VIOLATE PRIVACY.

Never email or contact other members without their permission, or, if you have a business or blog, add people to your newsletter list. Violating this is grounds for immediate removal. If in doubt, email support@ruthsoukup.com. We’re always here to help finesse any situation; better safe than sorry. 

  1. NO PROMOTIONS.

Do not post promotional links, including affiliate links in the group. This includes links to your free and paid products, affiliate links to other courses, or any other items that you may make an income on. If you have a link that you’d like to post, please contact one of the group admins before posting. All promotional links and posts will be removed. Repeated posts are grounds for removal from the Facebook Group. 

  1. DO YOUR DUE DILIGENCE.

If you decide to hire anyone or create any contractual relationship (verbally or written) with someone you’ve met through the ACTIVATE Community you do so at your own risk. 

Please do your due diligence and always get clear, written contracts and service agreements in place. While we love to believe everyone in the world is honest and ethical, that’s just not the case. RSO Inc., Ruth Soukup, and all other members of the LWSL or EBA team do not vouch for or endorse any member of the Community, and we are not responsible for any loss of revenue, damages, breach of contract, or any other unfavorable circumstance as a result of that relationship.

*PLEASE NOTE* *Blocking or attempting to hide your posts from any group Admin is grounds for immediate dismissal from the group.*  

By adopting this Code of Conduct, ACTIVATE members commit themselves to fairly and consistently applying these principles to every aspect of participating in this group.

Members who do not follow the Code of Conduct will have their membership revoked and forfeit any payments made.

This Code of Conduct applies both within project spaces and in public spaces when an individual is representing the project or its community. 

Instances of abusive, harassing, or otherwise unacceptable behavior may be reported by contacting support@ruthsoukup.com. 

All complaints will be reviewed and investigated and will result in a response that is deemed necessary and appropriate to the circumstances. Members are obligated to maintain confidentiality with regard to the reporter of an incident.

Additional Program Policies

EBA 4.0 Refund Policy 

**Please note that this program has been sunsetted and is no longer available for purchase. This refund policy applies to anyone who purchased EBA 4.0 within the last 365 days.**

We know that EBA works when you do the work. That said, if you complete the course and have not seen an improvement in your online business, you may request a full refund of your base (Silver level) tution. Please be aware that if you purchased our Gold or Platinum packages, you are still only eligible for a refund to your base tuition, as those packages include additional resources and options that are non-refundable.

In order to be eligible for a refund to your base tuition to Elite Blog Academy, you must submit your completed homework for all 36 assignments by 365 days from your purchase date. You can send your fully completed assignments to eba@ruthsoukup.com. This should include screenshots of your before and after blog design, analytics, and income reports.

If you choose our payment option, please be aware that this is NOT a subscription; instead, you are choosing to split your one-time payment into multiple monthly payments. Please be aware that if you choose this option, your access to the course will be limited to the first three units (1st module) until you have paid in full. 

We know that if you do the work, you will achieve results in your blogging business and your life. We’re challenging you to think differently, to behave differently, and to become the blogger you’re meant to be.

You can’t and WON’T get results by osmosis or by chit-chatting with other EBA members. You must do the work. We cannot emphasize this strongly enough. YOU must do the work. You MUST do the work. You must do the WORK. We put a tremendous amount of time and energy into this program. You need to match that energy. We have a zero tolerance policy for tire kickers or people with outrageous expectations, or who spend copious amounts of time complaining and very little actually getting their hands dirty.

Success in this program requires that you take consistent, focused action.

  1. Take it slow. Don’t try to rush through the each unit as quickly as possible, or to watch all 12 unit videos in one sitting. There is no cliff notes version of this course, and there is no secret formula that you are missing. If you want it to work, you have to DO THE WORK. These units are intended to be digested slowly, one at a time, over a period of time. At the bare minimum, you should give yourself a week to complete each unit, but truthfully some units may take longer to get through and to get the most benefit from. Don’t underestimate the huge amount of information you are going to be receiving. I have broken it down into bite size pieces to make it manageable and to give you a plan of attack, but that doesn’t mean you should skim or rush. You will need time to soak it all in and to make it work for you.
  2. Don’t skip ahead. Resist the urge to skip over the “boring” fundamentals because you are eager to get to the “good stuff.” I promise you, it is ALL good stuff, and the fundamentals are just as important—if not more important—than everything you will learn later on. These course units are intended to be followed in order, because each new unit builds on the previous ones.
  3. Complete ALL your course assignments. The thirty-six assignments in this course were not chosen at random, or invented just to add bulk. Each one has a purpose, and, like the course units themselves, each one is intended to build upon the previous one. That means if you skip one, you will be hindering your progress, and you will probably just need to go back and do it anyway. The bottom line is that you can’t expect Elite Blog Academy to magically work for you. You need to do the work. If you’re looking for an easy way to make money, or to just copy and paste someone else’s ideas, or follow some cookie cutter program to blogging success, this is not the program for you.
  4. Remember that this course is here to make your blog better, and sometimes change can be hard, or even a little painful. And don’t forget that what you get out of this course will depend on what you put into it. No one can do it for you!

Policy Regarding Refunds Denominated In Foreign Currency

All transactions made by Ruth Soukup Omnimedia, Inc. are denominated in US Dollars. If your transaction requires a conversion to a currency other than US dollars, those charges are controlled by the processor. If a refund is required, please be advised that the refund will be issued in US Dollars at the same price as the original purchase. Any difference between original foreign currency exchange rates and foreign currency exchange rates on the date of the refund are the responsibility of the purchaser. Ruth Soukup Omnimedia, Inc. is nor responsible for foreign currency exchange rates or charges.

EBA may host message boards, chats, and other public forums on its Sites. Any user failing to comply with the terms and conditions of this Agreement may be expelled from and refused continued access to, the message boards, chats, or other public forums in the future. EBA or its designated agents may remove or alter any user-created content at any time for any reason. Community forums, message boards, chats, and other public forums are intended to serve as discussion centers for users and subscribers. Information and content posted within these public forums may be provided by EBA staff, EBA’s outside contributors, or by users not connected with EBA, some of whom may employ anonymous user names. EBA expressly disclaims all responsibility and endorsement and makes no representation as to the validity of any opinion, advice, information, or statement made or displayed in these forums by third parties, nor are we responsible for any errors or omissions in such postings, or for hyperlinks embedded in any messages. Registration

To access certain features of the Site, we may ask you to provide certain demographic information including your gender, year of birth, zip code, and country. In addition, if you elect to sign-up for a particular feature of the Site, such as chat rooms, weblogs, or bulletin boards, you may also be asked to register with us on the form provided and such registration may require you to provide personally identifiable information such as your name and email address. You agree to provide true, accurate, current, and complete information about yourself as prompted by the Site’s registration form. If we have reasonable grounds to suspect that such information is untrue, inaccurate, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof). Passwords
